KUALA LUMPUR: Puncak Niaga Holdings Bhd’s unit Puncak Niaga Construction Sdn Bhd (PNCSB) has been ordered to pay its former subcontractor, Genbina Sdn Bhd, RM5.9mil out of the principal claim sum of RM15.7mil.
In a filing with Bursa Malaysia on Tuesday, Puncak Niaga said PNCSB had “successfully defended” a substantial portion of Genbina’s claims in a dispute regarding sewerage pipe network construction works in Bunus, Kuala Lumpur.
The dispute, which was settled in arbitration under the Construction Industry Payment and Adjudication Act 2012, referred to the notices of adjudication from Genbina dated May 27 and June 14, 2016.
Genbina had issued two notices of adjudication dated May 27, 2016, to PNCSB on disputes arising from two separate alleged payment claims totalling RM11.2mil. The following month, Genbina submitted another notice of adjudication, this time seeking a principal sum of RM4.5mil.
The adjudications for two further claims totalling RM7.3mil plus interest, cost and/or other relief (for the notices from Genbina in July and August 2016) were both dismissed, with a combined cost of RM158,000 awarded in PNCSB’s favour.
