Dear Madam Koo,


I understand that the moment one wins the auction, he/she will be responsible for all the utiltiies . Suppose the previous owner is staying there and refuse to move, who will bear the utilities bill? And if the previous owner is given 3-4 months notice to move, who will bear the utiltiies during that 3-4 months?

Hi. Mdm Khoo.

I bought a property during high court johor auction. The property is free from caveat, yet the owner of the property play dirty trick, he placed a caveat to interupt my property loan. Do we have our rights to remove the caveat? how? coz our time is limited to 120 days. i heard of we can get the form 19H from the land office to remove the caveat.. is it true? My email address.. phew ... i thot it is easy to purchase an auction properties, well its sound cheaper but the troubles that you have to make through in possessing the house. I remember my boss once bought this kind of property. The price is damn good as the built area, land area were huge, bungalow with 6 rooms, 6 bedrooms , etc...it cost him only RM240,000 (Kemaman, Terengganu).. but the hassle is as good as the price is!

From my personal view, looking at the lower price of the type of property to purchase, there are obstructions to get over with...however, its worthy.

I`m interested with an apartment currently up for auction. But after reading all the post here, I worried that the owner/tenant refuse to move out eventhought I`ve win the bid and proceed with signing S&P. Anyone here can advise?

Actually, best if You could obtain a copy of Proclamation of Sale (POS), which contains Condition of Sale (COS).

I'm an Auction Property coordinator (Agent lah), and I always emailed POS to my client, ASAP, so they can study it.

Based on COS, you would know what covered and not covered by the Assignee Bank, and what you should pay attention to, I think had been mentioned above.

By the way, COS usually comes in lawyer's language, so make sure you have one of them to assists you !
