I am in the process of selling my house. My Individual Title is with the bank (my Financier). My lawyer has requested and received the redemption and undertaking statement from my bank. The new purchaser's bank has stated that the redemption amount or first release will be made after the MOT has taken place. The individual title has to be returned to the developer for them to effect the MOT. However, my bank has refused to returned the title which is still under the developers name.
From what I see is that my bank has been delaying this case so that I will have to keep paying my installment by dragging my case.

My lawyer has requested the developer for a letter of authorisation to collect the title from my bank.

Questions:
1. What course of further action can I take if the bank refuse to release the title?

2. How can I collect the balance of the difference of the redemption amount against the sales price as stated in the new S&P between me and the new buyer?
