May I know why after we sign S&P Agreement, that 10% deposit need keep by Lawyer not direct for vendor, lawyer tell me must need wait untill consent out, is that true?

If consent is fail, 10% deposit need give back buyer?

Because is my 1st time sell house, so need to know this information, hope have anybody to help me, thanks!

usually 10% kept by lawyer as until consent then not sure sale going ahead.

if consent fail usually give back money back to buyer.

but it all depends on what the terms in s&p are. but above is what is normal.

Hi Yunnie,

What property and which area do you sell?For leasehold property, normally we need a consent.However, the 10% can be either keep buy the lawyer if both buyer and purchaser is agree with it..But, if you not willing to do so, you have the right to get the 10% first as this normally is the process after signing SnP.

The lawyer is the purchaser lawyer or your own lawyer?Do you have your own lawyer?Normally the 'purchaser lawyer will have such condition to protect his purchaser. However, you can ask them for the 10% first if you need the money cos you do not know how long they need to take for the consent and in case it is fail to transfer the consent, only you give back the money to your purchaser.

I will not sign the SPA if the 10% is not given to me as an owner. However, unless this property has not obtained its CCC / CF

If you have a solicitor he should be able to advice you pertaining to this matter.
