Dear Helpers,

I'm frustrating with the situation I'm in right now.

My late father rented piece of land to this one company for 5 years contract with very unreasonable amount (i believe he was badly influenced by them).
The contract expired two days ago. 14 days before the expiry date, i under instruction of my mother (new owner) had sent a writing notice to this company telling if they want to continue they must agree to the new rate proposed there (increased 100%). Also stated in that notice if they not interested, they must return the land on the day that contract finished (two days ago).

Now they refuse to move out from the land (all their belonging are there - huge construction materials). They arrogantly told me that the new price unreasonable and to move them out, the notice should be given 3 months in advance. Now it seems that they want to force us to agree with their price and term and if not they are entitle to stay another three months since they need to find new place.

What should I do, we cannot afford a lawyer. How much the lawyer cost, is it worth?

If you really aim to get the land back, you should be getting a lawyer and then present enough evidence so that the lawyer can be convinced enough to help you out in your problem.

It will be worth the effort if you get a lawyer than just doing it on your own, which of course, is not that fair since the company you are fighting up with has their own lawyer too.

You are the landlord and they can't push you to their demand. If their contract already expire then the best thing you can do is let them know that they need to move out 30 day notice is enough and if still they are not willing to move out let the sheriff do the works for you.

I would not be able to advise you further unless i have peruse the tenancy agreement.

However normally the tenancy agreement would have a clause which require the tenant to serve a notice to the landlord if they want to renew the tenancy agreement. Moreover, there must be a clause that allowed the landlord to adjust the rental or subject to terms an conditions agreed upon by both parties. However, this is still subject to there is an option clause which allow the tenant to renew their tenancy.

You need to insist to let them move out from your place, it is really better if you are going to hire a lawyer so that they can give you more information on the best things you can do in your land. Lawyers service is really a worth to get because they can give you the help that you are want to achieve.

Why are you not taking a big step against them? If you have contract then you can easily claim for that. You just have to hire an agent or lawyer who can better help you out in this regard.
