What you did and what she did are two different things. You described a real cut situation that you can prove with documents, she is accusing the tenant of breaking into the water closet and it is obvious that the tenant is not owning up to that (otherwise management wouldn't have charged the landlord), so she can be sued for saying in public that she commited a crime she claims she did not commit and was never convicted of.

Hi Chee,

First off, if the tenant is actually paying the rent, then why would you try to mess with that even if you have a technical ability in the contract? How late are they with the rent? If it is a few days, my advice is learn to live flexibly and let it be. If it's a few weeks and you're not happy about their excuses, then see if the eviction notice is what you would like to do.

Anyway, as far as electricity bills are concerned, there's no real issue in that area since TN allows the bill to go to a 1000 ringgits before taking any action. I myself don't pay them except every 3 to 4 months.

As for your clause, I have noticed that one before in other drafts. I believe it is a mis-copied clause with a fatal error -in my opinion-: \"shall absolutely determine\" is not an effective term to communicate without a doubt that the tenancy contract is null and void. The clause gives you right to \"re-enter\" the premises, but does not terminate the agreement. All in all, yes you can tell them to leave, but they can simply say \"no\". You'll still have to go through the whole eviction process I believe.

Check with a lawyer on this one.

Bro, thanks for your advise.

It's because they didnt pay the utility bill and it's more than the deposit RM500 they put on me. The outstanding utility bill (electrcity RM500++, water bill Rm100++) is close to RM700.

Hence, I think I have the right to re-enter the premise since they not paying the utility bill more than 14 days. Their rental is always late. I can imagine that they will stop to pay rental soon. Hence, I hope to end the contract earlier to stop the loss.

You should file first a legal action against the tenant and what do you want the tenant to pay you before they move out.

File this on your local authority so that they may help you out in getting your tenants out.

if the unit is rented out by an agent, why don't owner get their agent to sort it out with the problematic tenant?

I am now in position that i closed TNB account when i found out that my tenant did not pay TNB on time. in fact earlier of the TNB disconnected electricty (by remove fuse), tenant reinstall back electricty by brought a new fuse. I lodged a complain to TNB and TNB investigated under stealing electricty. This prompt me to close the account.

At the same time, tenant did not pay rental for 3 months and refuse to respond. warming letters and lawyer letter have been send.

Frankly closed TNB account is part of my plan to get tenant move out. I used tenant actions of
stealing as an excuse.

Is this right?
